These Terms of Service (“Terms”) govern your access to and use of mcqueendigital.ca (the “Site”), operated by McQueen Digital (sole proprietorship), based in Red Deer, Alberta, Canada. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
The Site is an informational and marketing resource for McQueen Digital. You may browse the Site and submit inquiries for lawful purposes only. You agree not to:
- Use the Site in any manner that could damage, disable, overburden, or impair it;
- Attempt to gain unauthorized access to any part of the Site, other accounts, or connected systems;
- Submit content that is unlawful, harassing, defamatory, or infringes the rights of others;
- Use automated scripts, scrapers, or bots to collect information from the Site without our written permission.
2. Intellectual property
All content on the Site — including text, graphics, logos, images, and software — is owned by McQueen Digital (sole proprietorship) or its licensors and is protected by Canadian and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission.
MLS®, Multiple Listing Service®, REALTOR®, REALTORS®, and the associated logos are trademarks of The Canadian Real Estate Association (CREA) and identify real estate professionals who are members of CREA. Use of these trademarks on client websites is subject to CREA’s rules.
3. Services, billing, and cancellation
Pricing, feature descriptions, and package contents shown on the Site are provided for informational purposes and may be revised from time to time. A binding agreement for services exists only when both parties sign a written engagement or when we confirm your order in writing.
Where you engage us for services, the following apply unless your written engagement states otherwise:
- Setup fee. One-time setup fees cover the initial build and configuration of your website and are non-refundable once work has begun.
- Subscriptions. Monthly and annual plans renew automatically until cancelled. The payment method on file is charged at the start of each billing cycle.
- Minimum term. Month-to-month plans carry a three-month minimum commitment, after which they continue month-to-month. Annual plans run for the prepaid year and renew annually.
- Cancellation. You may cancel at any time through your billing portal or by contacting us. Cancellation takes effect at the end of your current paid period; fees already paid are non-refundable except where required by law.
- Payment processing. Payments are processed securely by Stripe; we do not store your full card details.
4. Third-party links
The Site may contain links to third-party websites or services that are not operated by us. We are not responsible for the content, privacy practices, or availability of third-party sites. Accessing third-party links is at your own risk.
5. Disclaimer of warranties
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied — including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not warrant that the Site will be free of errors, viruses, or other harmful components.
6. Limitation of liability
To the fullest extent permitted by law, McQueen Digital (sole proprietorship) is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Site — even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Site or these Terms is limited to CAD $100.
7. Indemnification
You agree to indemnify, defend, and hold harmless McQueen Digital (sole proprietorship) and its officers, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your use of the Site or your breach of these Terms.
8. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Governing law and jurisdiction
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the courts of Alberta, Canada.
10. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page will reflect the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
